Terms of Use

These terms are an agreement between you and DTF Port LLC ("we", "us") for the Confidante app and service. By using Confidante you agree to them and to our Privacy Policy.

1. Who can use Confidante

You must be 18 or older. You're responsible for keeping your phone and account secure.

2. What Confidante is, and isn't

Confidante is an AI, not a person. Its characters are AI personas. It is not a therapist, doctor, counselor, lawyer, or emergency service, and it doesn't provide medical, psychological, legal, or financial advice, diagnosis, or treatment.

It can be wrong. AI replies can misunderstand you, be inaccurate, or be unsuitable. Use your own judgment and talk to a qualified professional about decisions that matter.

Not for emergencies. If you or someone else is in danger, contact local emergency services or a crisis line right away.

3. Plans and subscriptions

New accounts get a 7-day trial with unlimited messages and up to 30 minutes of calls. After that, the free plan includes a daily message limit and no calls.
Confidante Plus is an auto-renewing subscription, monthly or yearly, with unlimited messages and 60 minutes of calls a month. Prices are shown in the app before you buy.
Payment is charged to your Apple ID account when you confirm the purchase. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
You can manage or cancel your subscription in your App Store account settings. Deleting the app or your Confidante account doesn't cancel it.
Refunds are handled by Apple under its policies.
We may change plan features or prices; changes to a paid subscription apply from the next renewal, with notice as Apple requires.

4. Your content

You keep ownership of what you write and say. You give us permission to store and process it, including through our AI providers, to run Confidante for you, and to derive anonymous scenarios as described in the Privacy Policy. Replies Confidante writes for you are yours to use.

5. Acceptable use

Don't use Confidante to break the law, to harm, harass, or impersonate others, to create sexual content involving minors or any content that exploits people, to try to extract our systems' instructions or other users' data, to interfere with or overload the service, or to resell or automate access. We may limit or end access for misuse.

6. Availability and changes

We work to keep Confidante available, but it may be interrupted, changed, or discontinued. We may update these terms; if a change is significant, we'll tell you in the app, and continuing to use Confidante means you accept it.

7. Ending your use

You can stop using Confidante and delete your account at any time in Your space. We may suspend or end accounts that violate these terms.

8. Disclaimers

To the extent the law allows, Confidante is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, accuracy, or uninterrupted availability.

9. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for decisions you make based on Confidante's replies, and our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

10. Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, unless the law where you live gives you the right to have its laws or courts apply.

11. Apple

If you downloaded Confidante from the App Store: these terms are between you and DTF Port LLC, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation. Apple isn't responsible for claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims; we are, as these terms describe. You confirm you're not in a country subject to a U.S. government embargo and not on a U.S. government list of prohibited or restricted parties. You must follow any third-party terms that apply when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
